Terms of service

Effective: October 24, 2026

Last updated: October 24, 2026

1. Agreement and eligibility

By creating an account or using Fluxer, you agree to these terms, our privacy policy, and our community guidelines. If you do not agree, do not use Fluxer.

If any of these terms conflicts with mandatory local law, the law wins, and where the conflict concerns personal data, the privacy policy wins over these terms.

You must meet the minimum age in your country, which is generally 13 and higher in some places, as listed in our minimum age guide. If you meet that age but you cannot legally agree to these terms on your own, a parent or legal guardian must review these terms and agree to them on your behalf before you use Fluxer.

If you let a minor use your account, you confirm that you are their parent or legal guardian and that you are responsible for what they do on Fluxer.

We work out eligibility from what you tell us and from your approximate location. Section 3.2 of the privacy policy explains how regional restrictions work and how to ask for human review. You may not use Fluxer where doing so is unlawful, where sanctions or export controls prohibit it, or after we have terminated your account for breach of these terms, unless we agree in writing that you can return.

These terms apply to ordinary consumer, personal, and community use of the official Fluxer service run by Fluxer Platform AB, meaning its apps, APIs, and websites.

Fluxer is open source, and an instance that someone else hosts runs under that operator's own terms. A separate written agreement between you and us controls only where that agreement expressly says it replaces these terms.

2. Your account and acceptable use

You are responsible for keeping your credentials secure, giving accurate account information, and telling us promptly about suspected unauthorized access through the support route on our company information page. You are not responsible for activity where mandatory law says otherwise, and nothing here limits non-waivable consumer or payment rights concerning unauthorized charges or security incidents.

Your use of Fluxer must comply with these terms, the community guidelines, and applicable law, including other people's privacy and intellectual property rights.

2.1 Availability and changes

Fluxer has no service-level agreement, and outages, interruptions, and performance issues can happen. We may add, change, or remove features as Fluxer develops. Access can differ by region, device, account type, or applicable law, and we may limit it temporarily for maintenance, security, legal, or technical reasons. When a change is significant, we give you notice about it wherever we reasonably can.

If a change materially and adversely affects a paid feature you have bought, nothing in these terms limits your mandatory consumer rights, including any rights to conformity, repair, replacement, price reduction, cancellation, or refund.

2.2 Unsupported high-risk use

Fluxer is not designed or supported for safety-critical use, and you must not rely on it anywhere a delay, outage, security failure, or error could reasonably cause death, injury, environmental harm, or material disruption to an essential service.

You must not use Fluxer yourself, or let anyone else use it, as a primary, backup, or failover system for military or defense operations, emergency or first-response dispatch, healthcare or life-sustaining decisions, utilities, energy, water, sanitation, transport, or other critical infrastructure or essential public services.

3. Your content

3.1 Ownership and the permission you give us

You own the content you create and share on Fluxer, and you are responsible for making sure you have the rights and permissions needed to share it.

By using a feature that handles content, you give Fluxer a limited, worldwide, non-exclusive, royalty-free license to host, reproduce, transmit, display, and technically adapt it, only as needed to do what you and other authorized users ask.

That includes delivering your messages to their recipients, showing your profile and community content where you placed it, and technical processing such as compressing, transcoding, or resizing media so it works across devices. We sublicense these rights to our hosting and infrastructure providers only so they can run those features, and they are contractually barred from using your content for their own purposes.

This license gives us no independent rights over your content.

We never use it to train, fine-tune, or evaluate AI or machine learning models, never use it for advertising or behavioral profiling, never mine, analyze, or aggregate it for our own commercial benefit beyond running the service, never sell or license it for anyone else's independent use, never display it in a context other than the one you chose, and never feature it in marketing without your explicit, separate consent.

Beyond this, we disclose your content only when valid legal process, a court order, or applicable law compels us, or as section 4 of the privacy policy describes. When we are compelled to disclose it, section 14 of the privacy policy says when we tell you.

The license ends for a piece of content when you delete it, subject to the limited retention periods and legal obligations in section 7 of the privacy policy.

3.2 Content safety

We run no generative AI over your content.

Section 5 of the privacy policy explains our automated content safety checks.

3.3 Deletion and exports

Sections 7.3 and 8 of the privacy policy explain how to delete and export your content and how long deleted content takes to leave our systems.

Send copyright complaints through the copyright route on our company information page. A complaint should identify the protected work, locate the material on Fluxer, explain why the use is unauthorized, confirm that the information given is accurate, and show that you are the rights holder or authorized to act for them.

You can also send a complaint under a pseudonym, or through a representative who acts for you, such as a law firm or a rights-protection service.

We may remove or restrict allegedly infringing material, and when we do, we tell the affected user. The statement of reasons identifies the content acted on, the ground for the action, and the rights holder or category of right concerned, but we do not pass your direct contact details to the affected user unless the law requires it.

A counter-notice may be available where the law permits, and you can appeal as section 6.2 describes. Repeated infringement can lead to account termination.

4. Paid services

The Operator Pass terms also apply to the Operator Pass.

4.1 Payments and renewal

By providing a payment method, you authorize Fluxer and our payment provider, Stripe, to charge it for purchases, recurring fees, and any applicable taxes, and you confirm to us that you are entitled to use the payment method you provide. You pay taxes, fees, and charges on purchases, except those we must collect and remit.

Plutonium is DRM-free digital content. It needs an active account in good standing and internet access, and works wherever Fluxer is available, on web, desktop, and mobile. We show features, compatibility, billing period, and price before you buy.

Subscriptions renew automatically until you cancel in your account settings. Cancellation takes effect when the current paid period ends, and you keep access until then. Unused time is not refunded unless these terms or the law say otherwise.

If you buy Plutonium in our iOS app through the App Store or in our Android app through Google Play, Apple or Google bills it and renews a subscription under its own terms. You manage or cancel that subscription in your Apple or Google account.

While your subscription stays active and renews without a break, you keep the price from when you started or last changed it. Temporary discounts still end when they expire. If you change plans, or resubscribe after canceling or letting it lapse, the price offered at that time applies to you and is shown before you confirm.

We may also lower prices or offer discounts when we choose.

4.2 Refunds

You can request a self-service refund for any Plutonium purchase you pay for through Stripe or Google Play, including subscriptions and gifts, from the Plutonium page in "User settings" within 3 days of the payment. These refunds are processed automatically, and one is available in each rolling 30-day period.

A refunded subscription ends immediately, and a refunded gift may be withdrawn from its recipient, who may be notified. A gift bought through Google Play can only be refunded with the self-service refund before someone redeems it.

Apple handles refunds for purchases made through the App Store under its own terms, and you ask Apple for them. You can also ask Google for a refund of a purchase made through Google Play, and Google handles it under its own terms.

For billing errors, unauthorized charges, or exceptional circumstances outside the self-service window, use the support route on our company information page. None of this reduces your mandatory legal rights to a refund, remedy, or withdrawal.

4.3 EU and EEA withdrawal right

If you are a consumer in the EU or the EEA, you can withdraw from a Plutonium purchase, including a gift purchase, until its withdrawal period ends, or for longer where the law gives you more time, without having to give a reason.

The withdrawal period ends at the end of the 14th day after the day of the payment. If that day is a Saturday, a Sunday, a Swedish public holiday, Midsummer Eve, Christmas Eve, or New Year's Eve, it ends at the end of the next working day instead. We set the end late enough for every time zone in the EU and the EEA.

Before you pay, checkout asks you to confirm you want Plutonium to start right away. You keep your right of withdrawal, and if you withdraw you pay nothing for the time you had it. For a gift, the right of withdrawal is yours as the buyer, even if the code was redeemed, and if you withdraw, the recipient loses what the gift gave them.

If you buy Plutonium for your business, you have no right of withdrawal under this section, but the self-service refund in section 4.2 still applies to you.

To withdraw, tell us in any clear way through the support route on our company information page. If the Plutonium page in "User settings" shows "Withdraw from contract here" next to a purchase, you can also withdraw with that button. We confirm by email that we received your withdrawal. We refund you in full within 14 days of your withdrawal, to the same payment method, and what the payment bought ends.

For a purchase made through the App Store, you withdraw through Apple's refund process, and Apple refunds you. If you send your withdrawal to us instead, we still accept it as your withdrawal and point you to Apple's refund process.

This does not affect other consumer rights that no contract can take away.

4.4 Failed payments and disputes

If a payment fails, we may retry it a reasonable number of times, charge a backup method you have added, and suspend or downgrade paid features until payment succeeds. You remain responsible for unpaid amounts, and any fees your bank charges for failed payments or disputes are between you and the bank.

You can always dispute a charge through your bank or payment provider. While a dispute is reviewed, related purchases may be restricted, and we may ask for information to investigate. Plutonium keeps working while the dispute is open.

A person on our team checks every dispute. A genuine dispute about an incorrect or unauthorized charge never leads to enforcement action. Apart from restricting related purchases while it is being reviewed, a dispute can lead to enforcement action only when it is fraudulent or in bad faith and all of the following are true.

  • You or someone you allowed made the payment.
  • We charged the right amount, and only once.
  • We provided the purchase as described, or a working Plutonium gift code.
  • We had not refunded the payment.
  • You disputed after that payment's withdrawal period in section 4.3 ended.
  • Your bank or card company gives a ground for the dispute other than a payment made by someone you did not allow, a wrong or repeated charge, a refund we owed you and did not process, or a purchase not provided as described.

If our payment provider flags a likely fraudulent payment, we refund it in full.

Payment disputes for the Operator Pass follow section 9 of its terms.

5. Privacy and third parties

Our privacy policy explains what personal data we process and why, who receives it, how long we keep it, and what rights you have and how to use them.

Nothing on Fluxer is end-to-end encrypted yet. Section 9 of the privacy policy explains how we protect your data and links to our end-to-end encryption roadmap.

Third-party services have their own terms and privacy policies, and we are not responsible for their content, availability, or practices. Sections 4 and 13 of the privacy policy explain which third parties get data and how embedded content works.

6. Moderation, termination, and your own account choices

6.1 Disabling or deleting your account

You can disable or delete your account in settings at any time. Disabling signs you out everywhere without deleting anything, and signing back in reactivates it.

Deletion starts a 14-day grace period, and signing back in during that period cancels the deletion. Section 7.3 of the privacy policy explains what happens to your data after the grace period ends, including the deletion of inactive accounts.

6.2 Enforcement by Fluxer

We may remove or restrict content, features, communities, or accounts when we reasonably believe that these terms, the community guidelines, or the law have been broken, or when it is necessary for security, service integrity, payment protection within the limits that section 4.4 sets for payment disputes, or legal compliance.

We normally use proportionate measures and give advance warning before suspending or terminating an account, unless the breach is severe, poses an immediate risk, involves illegal activity, or unless the law prohibits giving notice.

If we apply a measure to your content, community, or account, you receive a clear and specific statement of reasons. It says what we did, the rule or legal ground, the facts relied on, whether automated means were used, and how to challenge it, including the out-of-court route for users in the EU. We hold back detail only where giving it would put someone at risk, compromise an investigation, or breach a legal duty.

You can appeal free of charge through the route on our company information page, from the email address on the affected account where possible, within 60 days of receiving the enforcement notice. Explain why you believe the decision is wrong, incomplete, or disproportionate, and include relevant context or evidence.

You can appeal each decision once, and temporary measures normally stay in place during review. Sending the same appeal again does not speed it up.

Qualified people review every appeal, and we decide it without undue delay. If a review shows a measure should not have been applied, for example because the content is not illegal and does not violate these terms or the community guidelines, we reverse it without undue delay and put right any paid benefit that was affected.

We may reopen a concluded decision if material new information emerges, or if the community guidelines change in a way that is relevant to the decision.

Operator Pass perk removals follow the Operator Pass terms.

If you are in the EU and remain unsatisfied, you can refer an eligible moderation dispute to a certified out-of-court dispute settlement body under DSA Article 21, after or instead of our internal appeal. The European Commission publishes the list of certified bodies, and we engage in good faith with any certified body you choose.

7. Disclaimers and liability

Fluxer is maintained with care but provided on an "as is" and "as available" basis. To the extent the law permits, we do not promise uninterrupted availability, perfect security, error-free operation, permanent storage, or delivery of every message.

This does not limit our responsibility for problems that are our fault, and it does not excuse our negligence, our willful misconduct, or our failure to meet the obligations that we have taken on in these terms and in our privacy policy.

To the maximum extent the law permits, Fluxer is not liable for indirect, incidental, consequential, special, or punitive loss, or for lost profits, revenue, goodwill, or data. Where liability can lawfully be limited, our total aggregate liability for all claims connected with Fluxer or these terms is limited to the greater of EUR 100 or the amount you paid Fluxer in the 12 months before the event giving rise to the claim.

No limitation applies where the law prohibits it, including liability that cannot be excluded for gross negligence, willful misconduct, or death or personal injury caused by negligence. If you are a consumer, the mandatory protections given by the law of the country where you live take priority over anything in this section.

If your use of Fluxer or your content causes a third party to bring a claim against Fluxer, you agree to cooperate with us. Where the law permits it, you also agree to bear the reasonable costs and damages that are directly caused by your actions. This does not apply to loss caused by our own breach, negligence, or misconduct, and it applies to consumers only to the extent that mandatory law allows it.

8. Disputes and governing law

If something goes wrong, contact us first through our support route, and we will work with you in good faith to resolve it informally within 30 days.

Swedish law governs these terms. If you are a consumer in the EU or EEA, that choice does not deprive you of the protection of the mandatory consumer law of the country where you live. Subject to consumer rights and other mandatory jurisdiction rules, the courts of Stockholm, Sweden, have exclusive jurisdiction over disputes.

Either of us may instead bring an individual claim in a competent small-claims court, and consumers keep any right they have to sue in their home courts.

These terms require no arbitration and waive no right to take part in a class action, collective action, representative proceeding, or other collective remedy available under applicable law. Consumers in the EU can also refer eligible disputes to a certified out-of-court dispute settlement body, as described in section 6.2.

9. Changes, communications, and sanctions

9.1 Changes to these terms

We may update these terms when the service, the law, or our business changes. Every update is published with its effective date and recorded in our changelog.

A change is material if it is adverse to you, meaning it removes or reduces a right or benefit you have, imposes a new obligation or restriction on you, increases what you pay for something you already have, or otherwise leaves you worse off than before. If it is genuinely unclear whether a change is adverse, we treat it as material.

Material changes take effect no earlier than 30 days after we notify you by email, in the app, or both, together with an explanation of what changed, so that before they apply you can review them, export your data, and delete your account.

A material change may take effect sooner only where the law requires it, and we then notify you as soon as we reasonably can and explain why.

Changes that are neutral or in your favor take effect when published and are recorded in the changelog. The community guidelines and privacy policy are updated under the equivalent change provisions they each contain. Continuing to use Fluxer after a change takes effect means you accept the updated terms.

9.2 Account communications

By keeping an account, you agree to receive the communications needed to operate it, including security alerts, payment receipts, enforcement decisions, and material policy notices. Marketing and promotional messages are separate and optional, and unsubscribing from them never affects required service communications.

Your account email address is our main way to verify your identity, so write from it if you can. We may require extra verification before we discuss or change an account, and if you cannot use that address we will look for another reasonable way to confirm who you are, though recovery is not always possible. Our company information page lists what we never ask for by email and the domains our email comes from.

9.3 Export controls and sanctions

You must comply with applicable export control and sanctions law, and you must not use, provide, export, or re-export Fluxer in violation of that law. We may restrict or terminate access where reasonably necessary for compliance.

10. EU Digital Services Act and UK Online Safety Act

Fluxer Platform AB is established in Sweden and provides an intermediary service subject to the EU Digital Services Act (Regulation (EU) 2022/2065) where it applies. Our DSA points of contact, and why we are not required to appoint a separate legal representative under Article 13, are on our company information page.

Section 6.2 explains how to appeal moderation decisions and how EU users can use out-of-court dispute settlement. Section 8 of the community guidelines explains how trusted flaggers designated under DSA Article 22 report content.

We meet the obligations that apply to us concerning orders from authorities, including the obligations under the Terrorist Content Online Regulation.

As a microenterprise, we are currently exempt from the transparency reporting duty in DSA Article 15, and we plan to publish voluntary yearly reports on our website as Fluxer grows. For the preceding calendar year, each report would show our moderation activity, the types of action we took, the automated tools we use, complaints and their outcomes, and orders from authorities and how we responded.

Our safety measures, moderation practices, and transparency work are designed to meet our obligations under the UK Online Safety Act 2023 for user-to-user services accessible in the United Kingdom, including the illegal content duties in Ofcom's codes of practice. The required risk assessments and children's access assessments are in progress, and this section will be updated as that work moves forward.

11. General terms

If any provision is invalid or unenforceable, it is adjusted only as far as needed to make it enforceable, or removed if that is not possible, and the rest stays in force.

These terms, the privacy policy, and the community guidelines are the entire agreement for ordinary use of Fluxer and supersede earlier agreements on this subject.

If a term goes unenforced, it is not waived, and a waiver counts only if it is in writing and signed by an authorized representative. You may not transfer your rights or obligations under these terms without our prior written consent, and any attempt to do so is void. We may transfer ours as part of a merger, acquisition, or sale of substantially all our assets, provided the recipient agrees to be bound by these terms.

Neither party is responsible for failure caused by events beyond reasonable control, such as natural disasters, pandemics, war, government action, power or telecommunications failures, or internet disruption, and each party must make reasonable efforts to mitigate and resume performance. This does not excuse payment obligations or anything the law does not allow to be excused.

These terms are written in English. Where a translation is provided for convenience, the English version controls to the extent that the law permits.

12. Contact

These terms are entered into with Fluxer Platform AB, organization number 559537-3993, c/o Embassy House, Östgötagatan 12, 116 25 Stockholm, Sweden.

You can find every contact route, including the routes for support, privacy, copyright, appeals, and legal questions, on our company information page.
